बिओसी पार्सपोर्ट र बेलायती नागरिकताबारे जानकारी (+Photo)

एचकेनेपाल डट कम, नोभेम्बर १९ -
गोर्खा चिल्ड्रन्स इन्टरनेशनल फोरम हङकङले बिओसी पार्सपोर्ट र ब्रिटीश नागरिकता प्राप्तिको लागि थप जानकारी दिन आज हङकङ नेपाली महासंघको कार्यालयमा एक पत्रकार सम्मेलनको आयोजना गर्‍यो।

पत्रकार सम्मेलनमा गोर्खा चिल्ड्रन्स इन्टरनेशनल फोरम हङकङका अध्यक्ष एनके राईले गोर्खाली सन्ततीहरूको हक, हीत र अधिकारको बिषयमा बोल्नुभएको थियो। उहाँले अहिले नेपाली समुदायबीच चर्चामा रहेको बिओसी पासपोर्टको बिषयमा जानकारी दिनुभएको थियो। सोही कार्यक्रममा उहाँले संस्थाको परिचय र भावी कार्यक्रमका बारेमा प्रकाश पार्नुभएको थियो। फोरमको भावी कार्यक्रमबारे जानकारी गराउंदै डिसेम्बर ३ मा हङकङमा रहेका गोर्खाली सन्ततीहरूबीच पाकिस्तानी क्लवमा बृहत भेलाको आयोजना गरिने बताउंनु भयो।

त्यसैगरी युकेबाट हङकङ आइपुग्नु भएका गोर्खा चिल्ड्रन्स इन्टरनेशनल फोरम युकेका महासचिव खुशी लिम्बुले १९७६ को जुन ३० भन्दा पहिले हंगकंगमा जन्मेका नेपाली राहदानीवाहकको बिषयमा केन्द्रित रहेर जानकारी दिनु भएको थियो। पत्रकार सम्मेलनको सञ्चालन गोर्खा चिल्ड्रन्स इन्टरनेशनल फोरम हङकङका महासचिव डिबी गुरूङले गर्नु भएको थियो।

गोर्खा चिल्डन्स इन्टरनेशनल फोरमद्वारा उपलव्ध गराईएको ब्रिटिश ओभरसिज सिटिजन पासपोर्टको लागि आवेदन र बेलायती नागरिकताका निम्ति आवेदन भर्ने मार्ग निर्देशिका एचकेनेपाल डट कमका पाठकहरुलाई उपयोगी होला भनेर यहाँ प्रकाशित गरिएको छ।

३० जुन १९७६ भन्दा पहिले हंगकंगमा जन्मेका नेपाली पासपोर्ट बाहकहरुलाई जानकारी

ब्रिटिश ओभरसिज सिटिजन पासपोर्टको लागि आवेदनः
बेलायती सरकारले हालैमा १९७६ को जुन ३० भन्दा पहिले हंगकंगमा जन्म लिएका नेपाली राहदानी बाहकहरु वास्तवमा ब्रिटिश ओभरसिज सिटिजन (BOC) नागरिकहरु हुन् भनी स्वीकार गरेको छ र जस अनुसार यदि उनीहरुले चाहेको खण्डमा पूर्ण बेलायती नागरिकता (राइट अफ एबोड सहितको ) का निम्ति आवेदन दिन सक्नेछन् ।

यदि तपाईं पनि यस समुहमा पर्नुहुन्छ भने ब्रिटिश ओभरसिज सिटिजन पासपोर्टका निम्ति आवेदन दिन सक्नुहुनेछ र जुन पासपोर्ट बेलायती ट्राभल डकुमेण्टको रुपमा प्रयोग गर्नसक्नुहुनेछ। तथापि, यदि तपाईं कुनै अपर्झट यात्रा गर्नुपरेको अवस्थामा मात्र यो पासपोर्ट लिन जरुरी हुन्छ। अन्यथा, तपाईं BOC पासपोर्ट ननिकालीकन सिधै बेलायती नागरिकताका निम्ति आवेदन दिन र तत्पश्चात बेलायती पासपोर्टका निम्ति आवेदन दिन सक्नुहुन्छ जसले गर्दा तपाईंको समय र पैसा दुबैमा बचत हुनेछ।

ब्रिटिश ओभरसिज सिटिजन पासपोर्टका निम्ति योग्य हुन निम्न सबै लागु हुनु पर्नेछ:
i) सन् १९७६ को ३० जुन वा त्योभन्दा पहिले हंगकंगमा जन्मेको हुन पर्ने,
ii) बिएनओ पासपोर्ट कहिल्यै लिएको हुन नहुने,
iii) औपचारिक रुपमा बेलायती राष्ट्रियता त्यागेको हुन नहुने र,
iv) नेपाली पासपोर्टभन्दा अन्य कुनै किसिमको पासपोर्ट लिएको हुन नहुने।

यदि तपाई बेलायत भन्दा बाहिर भएको खण्डमा, तपाई आफू रहेको मुलुकमा अवस्थित कुनै बेलायती राजदुतावास वा कन्सुलेटमा ब्रिटिश ओभरसिज सिटिजन पासपोर्टका निम्ति आवेदन दिन सक्नुहुनेछ। यसका निम्ति आवेदन फारम Form C1 ब्रिटिश कन्सुलेट जनरल हंगकंगको अतिरिक्त यसको वेबसाइटबाट पनि डाउनलोड गर्न सक्नुहुनेछ। ब्रिटिश ओभरसिज सिटिजनसिपको दावीका निम्ति यस Form C1 को सेक्सन ७ मा तपाईंले निम्न कुराहरु भर्न आवश्यक छ:

“I was a citizen of the United Kingdom & Colonies by birth in Hong Kong. At birth, I was also a citizen of Nepal by descent. On 1 January 1983, I was reclassified as a Hong Kong British Dependent Territories citizen by the British Nationality Act 1981. I did not renounce my British nationality prior to 21 years of age and therefore automatically lost my citizenship of Nepal. Having already lost my Nepalese citizenship, on 1 July 1997 I would have become stateless, save for the provisions of Article 6(1) of the Hong Kong (British Nationality) Order 1986 whereby I became a British Overseas Citizen.”

अर्थात, “मेरो हंगकंग जन्मको आधारमा संयुक्त अधिराज्य बेलायत तथा यसका उपनिबेशको नागरिक थिएँ। म जन्मँदा बंशजको आधारमा नेपालको पनि नागरिक थिएँ। जनवरी १ सन् १९८३ मा ब्रिटिश नेशनालिटी एक्ट १९८१ आधारमा म ब्रिटिश डिपेन्डेन्ट टेरिटोरिज सिटिजनको रुपमा पुनःबर्गिकृत भएँ। म २१ बर्ष पुग्नभन्दा अगावै मैले बेलायती राष्ट्रियता त्याग गरिंन र त्यसको आधारमा मेरो नेपाली नागरिकता स्वतः लोप हुनगयो। मेरो नेपाली नागरिकता पहिले नै लोप भइसकेको हुनाले १ जुलाई १९९७ पछि म राज्यबिहीन हुनेथिएँ। त्यसैले हंगकंग (ब्रिटिश नेशनालिटी) अर्डर १९८६ को दफा ६ (१) को प्रावधान बमोजिम म ब्रिटिश ओभरसिज सिटिजन हुनपुगें।”

ब्रिटिश ओभरसिज सिटिजन पासपोर्टका निम्ति आवेदन दिंदा तपाईंले आवेदन फारमका साथ निम्न कागजातहरु कन्सुलर अधिकृतहरु लाई देखाउन पर्ने हुन्छ: (i) हंगकंग जन्मदर्ताको प्रमाणपत्र, (ii) हंगकंग आई डी कार्ड (यदि तपाईंसंग भएमा), र (iii) तपाईंको चालु नेपाली राहदानी।

नेपालमा दोहोरो नागरिकताको प्रावधान नभएको आधारमा तपाईंले अहिले प्रयोग गरिरहनुभएको नेपाली राहदानी अबैध भएकोले तपाईंलाई बेलायती अधिकृतहरुले आफूसंग भएको नेपाली पासपोर्ट र नागरिकता सम्बन्धित निकायमा समर्पण गराउन सक्नेछन् (तर स्थानीय नीति तथा नियमहरु फरक पर्नसक्नेछन्)। त्यसैले गर्दा तपाईंले आवेदन दिनभन्दा पहिले आफ्नो नेपाली राहदानी र नागरिकताको प्रतिलिपिहरु राख्न नभुल्नु होला किनभने, भबिष्यमा कुनै पनि बखत कहिं न कहिं तपाईं आफू पहिले आफू नेपालको नागरिक पनि रहेको भनी देखाउन पर्ने स्थिति आइपर्नसक्छ।

बेलायती नागरिकताका निम्ति आवेदनः
ब्रिटिश ओभरसिज सिटिजनहरुलाई बेलायतमा राइट अफ एबोड को अधिकार हुन्न। त्यसैले तपाईंले पूर्ण बेलायती नागरिकताको दर्ताका निम्ति आवेदन दिन पर्दछ। यदि बेलायतभन्दा बाहिर रहेको खण्डमा तपाईंले सम्बन्धित मुलुकमा रहेको स्थानीय बेलायती राजदुतावास वा कन्सुलेटमा दर्ताका निम्ति आवेदन बुझाउन सक्नुहुन्छ। दर्ता आवेदनको निम्ति दस्तुर पाउण्ड स्टर्लिड. £१६१ लाग्छ जुन स्थानीय मुद्रामा तिर्नुपर्दछ। यदि तपाईं दर्ताका निम्ति हंगकंगमै आवेदन दिंदै हुनुहुन्छ भने फोन २९०१ ३०५० मा फोन गरेर तपाईंले पहिले नै एपोइन्टमेण्ट मिलाउनु पर्दछ।

बेलायती नागरिकताको दर्ताको आवेदन दिनका निम्ति दई बेग्ला बेग्लै प्रकारका फारमहरु छन्। ती मध्ये कुन चाहिं फारम भर्ने भन्ने कुरा तपाईं कहिले हंगकंग आउनुभएको र हाल कुन ठाऊँको सामान्य बासिन्दा हुनुहुन्छ त्यसमा भर पर्दछ।

i) यदि तपाईं ४ फेब्रुवरी १९९७ मा वा त्यो भन्दा पहिला नै हंगकंगको सामान्य वासिन्दा हुनुहुन्थ्यो र आवेदनको दिंदाको मितिमा हंगकंगकै वासिन्दा हुनुहुन्छ भने तपाईंले Form EM भर्नुपर्दछ।

ii) यदि तपाईं माथि भनिएका सामान्य बासिन्दा अर्थात Ordinary residency को नियम पूरा गर्न सक्नुहुन्न भने तपाईंले Form B(OS) भरेर आवेदन दिनुपर्दछ।

दुबै प्रकारका फारमहरु गाइडेन्स नोट सहित तलको वेबसाइटबाट डाउनलोड गर्न सक्नुहुनेछ ।

तपाईंले आवेदन बुझाउनुभएपछि आवेदन फारम कारबाहीका निम्ति लिभरपुल होमअफिसमा पठाइनेछ। यदि तपाईंको आवेदन सफल भएमा ब्रिटिश कन्सुलेटमा सिटिजनसिप सेरिमनीमा सामेल हुनपर्नेछ। तत्पश्चात तपाईं बेलायती नागरिक हुनुहुनेछ र बेलायती नागरिक पासपोर्टका निम्ति आवेदन दिन सक्नुहुनेछ।

    asome of them they dont have name in hong kong birth card and their parents name spelling is wrong, what we have to do before apply BOC or BRITISH PASSORT, could you please give us a advice for this proceedures. Thanku you.

    NOTE: We have a alise for the above mention documents.

I am sorry, Excuse me I was little bit confusion on the date how about those who had arrived after 4 feb/1997 will they get a chance too to apply for BOC or must be arrived b4 1997-Feb-04.

    04 feb 1997 ma 21yr old napugne Nepali le Nepalese citizenship give up garne Nepal ko kunai law chhaina.

    1. Apply garda Nepal Consulate batai garne ho.

    2. Tespachhadi Nepal Consulate le tapaiko document process ko lagi pra-rastra mantralaya ma pathau chha.

    3. Ani pra-rastra mantralaya le tapaiko jilla ma (kun thau bata nepali CTZ/NPP banauna vayo pahila) bujna pathau chha.

    4. yadi tapaiko CTZ/NPP Original chha vane or Record milchha vane tapaiko jilla le pra-rastra mantralaya lai tapaiko record pathau chha.

    Muna,

    If you were born in Hong Kong before 30 June 1976 and did not get a BN(O) passport, there is no need to take steps to give up your Nepal citizenship.

    It will be lost automatically under section 9(2) of the Nepal Citizenship Act 1964, when you became 21 years of age and did not renounce your British nationality.

    Losing Nepalese citizenship is automatic and does not require you to fill out any forms or make any applications.

    There is 2 version

    1. those who were born before 4 feb 1976 and was ordinary resident in HK on 4 Feb 1997, they can apply using Form EM same process as BNO holder. IN this case they don’t need to give up citizenship .

    2. those who were born before 30jun 76 and became ordinary resident after 4 feb 1997, they can apply using Form B(OS) in this case they must bring the letter from Nepal cousulate to proof they are no longer nepali citizen. Which is a long process.

    If you need proof that you have lost your Nepal citizenship, you should show go to the following link:

    You will see from the last sentence of paragraph 2 of this letter that the Government of Nepal has already confirmed to the British Embassy in Kathmandu that if a person born abroad does not give up his foreign citizenship “he/she automatically loses Nepalese citizenship after attaining the age of 21″

    If you apply using either Form B(OS) or Form EM you can print out and attach this to your application!

    I think everyone knows they need to give up their citizenship. This applies to BNO holder’s too.

    one more thing under Nepal Citizenship act 1964 , everyone who was born in hk before jun30 1976, they lost their citizen automatically when they became 21 years of age. Check the link by J Gurung. That means you r also no more nepalese man. BY law if want to be nepali citizen again you need to renounce ur british citizen and re-apply nepali citizenship hai. berore you make some stupid comments ” Ali yeso patra patrika website herne garnu la”.

    your also lost your nepalse citizenship automatically when you became 21 years old. But because you Have BNO ,you cannot apply for BOC.
    So person who have BNO they are under British Nationality (Hong Kong) Act 1997. that’s why you need to be in Hong kong before 4 feb 1997 to meet the requirment for full British citizenship. Thapa bhai sorry to say your not qualified for Full british citizenship. Unless they make some changes on British nationality (HK) 1997, about the ordinary resident.

    I was just browsing through all of your comments and it made me even more confused. My first question is can you or can you not apply for the BOC if you already posess a BNO? I was born before June 76, retained HK ID and a BNO in 95, lived in HK till ‘99-Now, do I meet the criteria with an already existing BNO? Any suggestions would be highly appreciated.

    once you have BNO you cannot apply for BOC. And also you cannot change your BNO to full British citizen becoz You came to HK after 4 feb 1997. Are you clear now?. May be you got confused bcoz this disscuss is manily about BOC.
    so ppl if you have BNO its better you don’t look at this disscussion it will make you more confuse. The BNO rules has not changed its same as before.

    At first, a big CONGRAT to those who are qualified to gain the BOC or Brit Passport.

    BOC ko barema, josukai le jesukai bhane pani, mukhya kuro, UK ma aayera survive hunu sakinchha wa sakinna bhanera elvaluation garnu ekdam jaruri chha.

    UK is land of opportunities, tara, jo manchhe language ma nipoon chhaina bhane, without doubt he/she will face a real hard time over here. Jasari hami le HK ma survive hunuko lagi Chinese bhasa sikyou, tyasari nai UK ko nimti, English language is very much vital. I have seen lots of Nepalese stranded over here due to lack of good knowledge on the language and not getting the right job even he/she has the experience.

    That’s why, mero advise to all is, BOC ko procress ko sath sathai, English language ma pani jod dinu hos. Natra, UK matra aayera kunai kaam chhaina.

    Neo is right you should not see this page and confuse yourself if you have BNO . But I think you are confused between British Citizenship and British Overseas Citizenship .Here ,the discussion is all about BOC and not BC . You said you were born before june 1976 and have BNO but were you born before 4 february 1976 ?If yes then why dont you directly apply for better one called British Citizenship .Why are you after this BOC ?

    ans to ur first Q. No you cannot apply for BOC once you have BNO.it doesn’t matter when you get you HKID and BNO. BUT if you came to HK (ordinary resident) b4 4 feb 1997, you can apply for Full British Citizenship.
    stupid bro, if you are BOC qualified then your Nepalese citizen is automaically lost. So you really don’t have to surrender Nepalese citizen Bcoz you r no more nepalese citizen (in theory hai). The British Cousulet is not asking us to surrender or citizen but asking us to bring the Letter from Nep cousulate dat we r in fact no more nepalse re. To surrender a citizensip and not being a neplese is a lot different thing hoina ra.
    there is always a good n bad thing about anything. Uk not necessarily suitable for everybody, and some may prefer hk n some may prefer Nepal. If someone really wants to make good leaving in UK than they must learn the language like Kaalsing said. ppl who have good language skill or good education they really have better opp than we have here in HK.     There have been a lot of rumours about BOC , BC and BC and every individual has different idea about the BOC.One discription doesn’t agree with another therefore, those who want to apply for BOC are advised to go directly to the British consulate’s consular section L3 along with documents themselves and ask whatever you like with consular section they will explain to you what is BC.BOC and BNO and how to apply for them.As far as document from Nepalese consulate is concerned you can ask them directly on telephone about the document you required to sumbit in the British Consulate.

    I did the same thing. Went to L3. they gave a form BOS and list of documents. One of the requirement is letter from nepal consulate confirming i’m not a nepalese citizen. I went to nepal consulate and they said i have to give up nepalese citizenship but as i read on BOS guide which says you shouldn’t hold or renounce other nationality after 2002. I’m confused because i have nepalese citizen when i come to HK for ID process. I came HK after 97 so i don’t have BNO. Do you have any idea what i should do next? thanx in advance.

    Dear Tulsi
    It seems you have got form only from the consular section and you did not ask any thing about BOC. I am not authority in Law but I will try to clear your confusion.
    1) It doesn’t make any difference whether you have BNO or not and when you arrived in HK. You are British Overseas citizen by birth and you have not renounced the British citizenship after you are 21 years old.
    2) Now British Government wants to know why we Nepalese born in Hong Kong were given Nepali Passport despite knowing that we are British citizen.So they need no longer Nepalese certificate from the Nepal consulate.
    3)As far is Nepalese consulate is concerned It doesn’t give no longer citizen certificate to any individual. But it interprates the Nepalese citizenship law and gives explanation to the British consulate formally that those Nepalese who hold foreign citizenship are no longer Nepalese citizen. I went to the Nepalese consulate for the same letter the other day and they said they are having discussion the case with British consulate and let us know within a week.
    Tulsi sir, we can not hold citizenship of two countries so you have to decide whether you are a British or Nepalese.
    These are things what I understood from the both consulates during the process of my application for BOC.

    British Consulate को 6 December 2006 को छलफल र निस्कर्ष अनुसार BOC वा British Citizen प्राप्त गर्न तलको सर्तहरु हुन आवश्यक छ:

    1. हङकङ जन्मेको हुनुका साथै BNO कहिल्यै नलिएको हुनु पर्ने ।

    2. ३० जुन १९९७ भित्र Nepal Passport बाहेक अन्य कुनै देशको Passport वा Citizenship लिएको हुनु नपर्ने ।

    3. ३० जुन १९९७ भित्र राज्य बिहीन अर्थात् नेपाली नागरिकता गुमेको हुनु पर्ने ।

    4. जो राज्य बिहीन अर्थात् नेपाली नागरिकता गुमेको भन्नाले ३० जुन १९९७ भित्र हङकङ आई हङकङको स्थायी बासिन्दा वा HK Permanent ID भै सकेकोलाई बुझिन्छ ।

    5. ३० जुन १९९७ भित्र २१ बर्ष पुगेको हुनु पर्ने साथै British Nationality पनि कानुनी रुपमा त्यागेको नहुनु पर्ने ।

    6. यी माथिको शर्त पुरा गर्नेहरुले BOC/British Citizen आबेदन गर्न नेपाली नागरिकता त्याग्नु पर्ने छैन । तर ३० जुन १९९७ अगाडी नै आफ्नो नेपाली नागरीकता समाप्त भएको प्रमाण चाही पेश गर्नु पर्ने हुन्छ ।

    Note: - कुनै पनि नेपाली नागरिक ले २१ बर्ष नपुगी सम्म नेपाली नागरिकता त्याग्ने प्रावधान नेपालको नागरिकता ऐनमा छैन । त्यसैले ३० जुन १९९७ सम्ममा २१ बर्ष नपुग्नेहरु British Nationality हुन सकेनन् । किनकी British ले हङकङमा राज्य ३० जुन १९९७ सम्म मात्र गरेको हो ।

    अर्को कुरा नेपाली नागरिकता ऐनमा कुनै पनि नेपाली बिदेशमा जन्मेर २१ बर्ष पुग्दा सम्मनमा पनि नेपाली नागरिकता ग्रहण नगरे स्वत: उसले नेपाली नागरिकता हुन गुमाउने छ ।

    Dear Amy,
    I was born in Hong Kong in 1967 and I arrived in Hong Kong in1998 and got HK ID. When I asked consular section in British consulate by showing all my documents they said I was eligible to apply for BOC and gave me a form stating all required documents. I think your case is the same as that of mine so you had better to go to the related place for inquiry along with all your documents.

    Actually if you r born in Hk before 30jun 1976, u r eligible for BOC or BC. There is no ordinary resident date requirement. That means doesn’t matter when you come to hk as long as you

The Nepalese consulate attache Mr. Shrestha has told me that it probably will be around two weeks before Kathmandu sends back any decisions about the matter.Let us hope that the Home Ministry in Kathmandu does not create anymore confusion and cuts through the bureaucracy and works towards a very prudent, fair and reasonable solution.

    Please don'’t forget that BOC and BC are for those who never held BNO. We could have held BNO if we had arrived before 1 July 1997. We don’t have BNO because we didn’t arrive in time.So we are qualified for BOC no matter when we arrived in Hong Kong.

    I was born in HK in1975. I applied for HK ID and BNO passport simultaneously from British embassy KTM in 1995.My HK id was approved and issued in 1995 while my BNO was belatedly approved and issued om March 1997.Recently i applied for british citizenship from HK.But my application was refused.Refusal letter states that my BNO was issued after february 1997, so they count me as a nepalese citizen. I am really disappointed,but there is a quite a large pool of BNO holders with similar situation.When i read the SinoBritish law i found that the law has left no room forBNO holder like us even though we are resident of HK before Handover.So i request all relevant organization and associations to help us through this forum.Please communicate with me anyone with similar fate.

    If you were born in Hong Kong before Feb 97, ie turned 21, at the time of handover, and if you did not renounce your BDTC( British Dependant Territories Citizen) at any British Consulate when you turned 21, then you became a BDTC by virtue of birth in BDT( British Dependant Territory-Hong Kong), and your Nepalese Citzenship should have been revoked automatically as stated in the Nepalese Nationality Law at that time.
    This is where the problem lies, because the British Government is asking the Nepalese Government , so why do these people still posses the Nepalese Passports and Citizenship cards?
    The British Consulate wants a clear answer from the Nepalese Consulate. If you do not consider these people as having Nepales citizens, then give them a letter saying so , and give an acceptable reason why their citizenships were not revoked when they became BDTCs?If an acceptable explanation and a letter stating their non-Nepalese status is issued , then the individual can proceed with his British Citinzenship application. If otherwise, then you can call the whole thing off, and consider yourself a proud Nepalese once again. So, what’s up Mr. Consulate General of Nepal? We are all looking forward to a speedy solution.I would like to add, if I may, that there are many here amongst us, that are hoping to obtain our rightfull British Citizenships and move on with our lives.

    The Home Office have already clearly understood Nepalese nationality law, as you can see from their own internal documents See:

    This is from the Home Office’s own information! So if the Home Offce accepts that a BN(O) aged 21 or over cannot be a dual Nepalese/British national, why do they suddenly need clarification that a BDTC aged 21 or over cannot be a dual Nepalese/British national?

    If you were Nepalese born in Hong Kong before 31 December 1982, you automatically became a Hong Kong BDTC. If you did not formally renounce your Hong Kong BDTC status before reaching the age of 21, you CANNOT be a citizen of Nepal. So if you were 21 years of age or older on 30 June 1997 (i.e. born before 30 June 1976) and never got a BN(O), you automatically became a BOC on 1 July 1997. This is clear as crystal - why does the British Consulate-General play games?

Now My curiosity is that will it really change the position of BNO passport holders who didnt qualified for British citizenship due to various interpritations? I am focusing to those who were born after 1976 and to those who didnt met the criteria set by the decision of February 4 1997. SinoBritish decision states that BNO is involuntary, that mean after acquiring BNO one who wish to get British citizenship must qualify or must fulfill certain term stipulated by Feb 4 1997 decision.According to your intelligence it crystallizes that whenever or however a Nepalese obtains another passport Nepalese citizenship is accordinngly revoked.

    Dear Gurkha Children International Forum, HKNepal.com and friends,

    My name is Damar Thapa.

    My quest for British Citizenship started after seeing the letter from Lord Avebury, House of Lords, and Tameem A. Ebrahim to SCMP (published on 27 November 2006). After getting necessary information from British Consulate General in Hong Kong, I wrote a letter and met our Nepalese Consul, but in vain (you all know what Nepalese Consul’s response is). After finding total deadlock on the process between two authorities, I wrote a letter to the Editor of SCMP, quoting the above-said letter of Lord Avebury, House of Lords, and Tameem A. Ebrahim. SCMP did not publish my letter, but last week I found that they rather had forwarded my letter to Mr. Tameem A. Ebrahim. Mr. Ebrahim kindly called me last Friday and updated on the progress on our BOC and British Citizenship campaign. He is very supportive of our rights and he also talked about his campaign for Indian Community in Hong Kong.

    Since our process is in total confusion, trapped between two authorities with no listening ears, I sought Mr Ebrahim’s help on this issue over the phone and on my email to him this weekend. This afternoon, he replied with very positive note that he is willing to help us (Nepalese Communities). According to his letter to Nepalese Consulate General of Hong Kong, he actually had met Nepalese Consul in Hong Kong in late December 2006 on this issue.

    Mr. Ebrahim with Lord Avebury campaigned for the rights of Indian Communities in Hong Kong and succeeded recently. If we can organize our group (yes, numbers matter!) and manage to bring Mr. Abraham’s experience and position to our campaign, I am very positive that we may be able to have relatively easy ride to victory. In my view, as one commenter commented, what we need now is one influential voice to make the authorities heed our call. The following is the extract of my email to him this weekend:

    “On the phone, you talked about the Hong Kong Indian Communities’ struggle. Nepalese community in Hong Kong is nowhere near Indian community in terms of influence, but what you have achieved in helping Indian Community has direct impact on us – so, we will, hopefully, be walking on the paved path of your success. Honestly, I cannot put it in words how important is your work for ethnic minorities in Hong Kong.”

    Mr. Ebrahim’s support is important, but how we organize our group is equally important– it is, basically, a synergy of Mr Ebrahim’s position/experience and our group solidarity.
    So, I appreciate if any of you (Gurkha Children Internation Forum, HKNepal, and individuals) contact me at thapa.damar@gmail.com (6341 8436) with comments and suggestions? At the moment, only thing we have is a rough estimate of how many Nepalese are eligible for BOC/BC, but one thing we have to do is bring as many eligible Nepalese as possible under one group to make our voice louder.

    It seems like our Nepal Consul-General in Hong Kong, Mr Bhattarai, is the one who is holding things up for us.

    Lord Triesman of the British Foreign & Commonwealth Office recently referred to the meeting between British & Nepal Consulate in Hong Kong on December 8. He said that “At a recent informal meeting between British consular staff and their Nepalese counterparts in Hong Kong, the Nepalese took the view that those with Nepalese passports and holding Nepalese citizenship cards were Nepalese citizens. Letters stating otherwise could not, therefore, be issued. However, once the provisions of the British Nationality Act and their implications under Nepalese law in relation to dual nationality were explained further, the Nepalese undertook to revert to Kathmandu for further advice.”

    More than two weeks earlier, on 22 November in Kathmandu, the Ministries of Home & Foreign Affairs told a visiting British Government delegation that there is a “total prohibition” on dual nationality in Nepal. Is Mr Bhattarai authorised to contradict Nepalese Ministries and say that Nepal allows dual nationality when it is not allowed under Nepalese law?

    On what basis or authority can he say this? Why is he contradicting the law of Nepal and saying that they allow dual nationality?

    Now he says he needs to get further advice from Kathmandu. If Nepal Consul does not understand the law properly why is he making incorrect statements without authority?

    When I wrote and then met Mr. Bhattarai, my assumption was that I was going to follow a well established procedure/requirements etc., coordinated between two authorities.
    On the meeting, however, I realized that Mr. Bhattarai had no confirmed decision on the issue.
    He said to me that he cannot provide me the letter as I am not a Hong Kong citizen. According to him, I have to have a foreign passport ie Hong Kong SAR passport (not just HKID Card) to loose the Nepalese citizenship. His answer was not relevant, but I too was not prepared (I had not taken all the legal references with me as I had expected that they should know better than I do!). Mr. Bhattarai, however, said at the end that the process is underway in Nepal, and they are waiting for that.

    There are two things I do not understand on Nepalese Consulate General’s stand:

    (1) Nepalese Government has clarified the laws, ie no dual nationality, so only thing Nepalese Consulate-general has to establish is if the person has another nationality ie BOC in this case. And to establish a person’s BOC status, British Consulate General is the right authority, not the Ministry of Foreign Affairs, Government of Nepal. I did not hear them talking about consulting British Consulate General on this issue at all.

    (2) We have been told by Nepalese Consulate General that they are going to send relevant documents to Nepal for verification purposes (to verify that citizenship certificates are genuine). Don’t you think they should verify this each and every time they issue our passports? We all should have applied passports at least once in Hong Kong.

    I was a citizen of the United Kingdom & Colonies by birth in Hong Kong. At birth, I was also a citizen of Nepal by descent. On 1 January 1983, I was reclassified as a Hong Kong British Dependent Territories citizen by the British Nationality Act 1981. I did not renounce my British nationality prior to 21 years of age and therefore automatically lost my citizenship of Nepal. Having already lost my Nepalese citizenship, on 1 July 1997 I would have become stateless, save for the provisions of Article 6(1) of the Hong Kong (British Nationality) Order 1986 whereby I became a British Overseas Citizen.”

    Ordinary resident means you have to be present on or before feb 04 1997 in hong kong and should stay continuously for atleast 3 months. Even if you hold BNO and HK ID before that date but if you come to HK after that relevant date then you will not be regarded as the ordinary resident at that time.

Oooo… I don’t have BNO cause I don’t want but BOC is different that’s by, it’s make easy to travel any where and any place in this uncompleted earth. one of my friend n’ I applied together but he has BNO too n’ I don’t have, every thing we have done together but after few months he got BOC but I didn’t so sad for me.     Can i getta boc or something if i was born in hk after 1976 to a mother who was born in hk …. now a british citizen? and myshelf no bno just permanent id came to hk in 1998…
